This class provides legal services to the City, its staff, and City Council. Incumbents assist in the oversight and provision of licensed professional legal counsel and representation to the City. Work may include: researching legal issues; providing legal advice and direction; representing the City in litigation; reviewing, processing, and defending claims against the City; reviewing and drafting contracts, documents, ordinances, and City regulations; participating in problem-solving regarding City issues; interpreting laws, rulings, and regulations; and representing the legal department to the community and when attending official meetings. Incumbents serves as a second level or higher supervisors and have middle management level responsibilities. Duties include making interpretive decisions on behalf of the organization regarding the means for executing goals established by City Executives and governing bodies, subject to constraints imposed by available technology and resources. Such interpretive decisions provide context for the work to be accomplished by subordinates supervised within the units managed. Incumbents supervises professional, paraprofessional, and support staff including conducting performance evaluations, coordinating training, and implementing hiring, discipline, and termination procedures.

  • Exercised: This classification typically supervises other employees.
  • Received: This classification typically reports to the City Attorney.
  • Note: Other reporting relationships may apply.

 

 

Duties include but are not limited to

 

  • Reviews documents, pleadings, ordinances, etc. 
  • Prepares for and attends court in area of focus; performs needed legal research; prepares discovery, legal memoranda, and correspondence. 
  • Analyzes records. 
  • Manages cases and programs in focus area. 
  • Attends various meetings. 
  • Answers questions from clients as necessary.

 

Qualifications, Special Certifications and Licenses

Knowledge (some combination of the following):

  • Appeals process in both state and federal courts
  • Civil procedure and discovery
  • Computer programs such as Microsoft Office Suite
  • Electronic databases and related software applications such as Fastcase, Lexis, Legal Files, etc.
  • Elements that must be proven in court for each hearing type
  • First chair trial experience
  • Laws related to focus area
  • Legal research and writing
  • Local rules of court for Richmond, Henrico, Chesterfield, and any other court where cases may be heard
  • Public procurement laws and regulations
  • Various burdens of proof that are required for court cases
  • Virginia and Richmond laws concentrating on code enforcement and delinquent property tax issues
  • Virginia civil and criminal procedures and discovery

Skills (some combination of the following):

  • Arguing persuasively based on laws and facts
  • Communicating with various internal and external departments
  • Conducting civil discovery in a timely manner
  • Determining the extent of the City's liability and exposure to adverse judgments
  • Developing case strategy
  • Identifying legal solutions to clients' issues
  • Investigating cases thoroughly
  • Managing high-volume programs and cases
  • Prosecuting code enforcement violations
  • Representing the City, agencies, and employees in lawsuits filed by citizens
  • Reviewing client departments' ordinances
  • Supervising coworkers and staff via evaluating and signing performance reviews, providing work direction, etc.
  • Working with senior City managers on a wide variety of matters
  • Oral and written communication

MINIMUM TRAINING AND EXPERIENCE:

  • Juris Doctorate
  • Seven years of progressively responsible legal experience, including two years of legal leadership experience
  • An equivalent combination of training and experience (as approved by the department) may be used to meet the minimum qualifications of the classification

   
LICENSING, CERTIFICATIONS, and OTHER SPECIAL REQUIREMENTS:

  • Admission to the Virginia Bar
  • Licensed to practice law in Virginia
  • Twelve hours of continuing legal education annually
  • Compliance with additional requirements that may be established by the City of Richmond
